Bismillaah (In The Name of Allaah)

A great way to find increase in rizq (sustenance) is to increase your charity and pay the zakat, that Allaah (swt) has made obligatory on all Muslims.  Giving zakat (Support of the Needy).  This is the third most important pillar in the five pillars of IslamZakat means ‘purification’ and ‘growth’. Giving zakat means giving a certain percentage of your earnings to the poor.  The percentage of zakat is 2.5% of savings, gold and silver (note this is a percentage on savings and not earnings). As everything belongs to Allah money is given to humans in a trust and we are to help the poor and needy with our own share ourselves. This Zakat works the same as pruning a rose bush the cutting back encourages new growth for the roses and for your finances while purifying the possessions you currently have.  Paying zakat is worshipping Allah by paying the amount of charity obligated on the ones who have enough money or possessions saved to help the poor in the community.  Paying the required zakat leads to cleansing the heart from the evil of misery.  It also fulfills the needs of Islam and Muslims.

“By no means shall you attain to righteousness until you spend (benevolently) out of what you love; and whatever thing you spend, Allah surely knows it.”

Soorah Al-Imran 3:92

The parable of those who spend
of their substance in the way of Allah
is that of a grain of corn:
It grows seven ears, and each ear has a hundred grains.
Allah gives manifold increase to whom He pleases;
And Allah cares for all and He knows all things.

Qur’an (2:261)

Zakaah From Businesses:

First of all, the business should be Halal.

There are three opinions amongst the scholars:

1. If a businessman earns a certain amount from his business, whatever he saves after taking care of his family’s needs and his business expenses, he pays Zakat of 2.5 percent on what he has saved.

2. A businessman has to pay Zakah on the commodities in his store. This would require evaluating the purchasing power of the commodity and then paying 2.5 percent on this amount.

3. Everything is from Allah and everything goes back to Allah. The more you give on your commodities, the better, and it does not have to be 2.5 percent.

    Requesting your value Fatwa (or opinion) on the following problem:

    I have acquired a residential Flat on tenancy basis against PUGREE. This Pugree system is prevailing all over Karachi and even in other cities of Pakistan and India.

    Under this system the tenants acquiring Flats/ Shops/ Apartments pays a huge amount of cash (repeat cash) as Pugree to the Land lords unofficially. The landlords do not issue any receipt for the cash so received and just issues monthly receipts for rent of the said Flat/Shop/ Apartment in the name of the Pugree paying tenants, indicating only the monthly rental value.

    For several lacs of rupees paid as Pugree remains only is based on trust. (But not in writing).

    According to current tradition PUGREE amount is never returnable / reimbursable and once received it becomes the booty of the Landlord.

    Whenever (say after one year, five year or 15 or more years), the said Tenant decides to sale his/ her Pugree paid tenancy rights to another Tenant, he/she may sale the same to any other person against the existing Pugree terms.

    For example if he/she had acquired the Flats/Shops on Pugree of Rs. 1,00,000/- and after several years when he/she sells off the same to another buyer at Rs. 10,00,000/- (prices always remain ascending) the landlord is bound to accept the new buyer as tenant and transfers monthly rent receipt for the said Flat/Shop in name of new buyer after UNOFFICIALLY collecting 10% or even more fee from the outgoing tenant and thus the process completes. The 10% or more fee being “off the record” collected by the Landlord on the basis of Sale proceed realized by the outgoing tenant.

    Similarly the next Pugree paid tenants also retains occupancy of the said Flat/Shop as TENANT, but he/she is never deemed as as owner of the said Flat/Shop. He would remain as TENANT only. (The statutory law does not recognize Pugree and hence the tenant despite paying pugree is known s ordinary tenant).

    This Pugree paid tenancy system is BRUTAL/EVIL, unlawful but has spread all over the human society as Cancer. There is no doubt about the same.

    Despite this filthy system another question arises as to WHO SHALL PAY ZAKAT on Pugree amount ?

    1. Whether the tenant would pay?
    If so, then why? Tenant has already paid off /spent the amount to buy occupancy right of the Flat. He has no access on this amount and this amount is not refundable under any circumstances. (If it had been DEPOSIT then it would remain refundable and is considered as receivable by the Tenant and in such case he is liable to pay Zakat on the same.

    2 Whether the Landlord would pay?
    If so, then the question arises that he has already spent the amount is and now holds no money.

    In my HUMBLE OPINION the Zakat would NOT BE PAYABLE by Tenant, because:

    i. He has spent the amount to buy occupancy right (NOT OWNERSHIP RIGHT) and by virtue to this holding absolute occupancy right he has renounced from cash paid as and cash gone off from his hand.

    ii. Under the present situation occupancy right must be taken into consideration like other payment being made on different intangible payments say water tax, which remains payable to government despite the fact whether you get water or not. OR minimum payment chargeable for unutilized Gas/Electricity Bills. You do not use even one unit of these services but if the meter is installed it means you have occupied the line.
